In 2005, the Ohio General Assembly enacted expansive tort reform legislation as part of S.B. 80. The legislation either created or amended approximately 50 statutes that directly and significantly impact negligence and other tort claims in Ohio. In addition, in 2003, the Ohio General Assembly enacted legislation as part of S.B. 120, which drastically changed Ohio law regarding joint and several liability. Combined, these two pieces of legislation have created sweeping changes as to the extent to which a person who is injured or killed in an accident may recover from one or more of the people who were at fault. There still is very little case law interpreting these new statutes. This makes it even more important for a person involved with a negligence claim to seek representation from attorneys knowledgeable about these new statutes.
