RECENT FAVORABLE VERDICT OBTAINED BY JAMES GALLAGHER

On May 9, 2007, Jim Gallagher obtained a favorable verdict in the case of Farwick v. State Farm Fire & Casualty Company tried in the Common Pleas Court of Clermont County, Ohio. The case involved an underinsured motorist coverage claim. The parties stipulated all issues except for the amount of the Plaintiff's damages arising from an automobile accident. The parties also stipulated that the jury would not be advised that the Plaintiff had already recovered $12,500 from the tortfeasor and an advance payment of $2,700 from State Farm. The jury would determine the total damages following which the Court would set off the $15,200 already paid to the Plaintiff.
The Plaintiff claimed a permanent and disabling injury to his thoracic spine. He asked for approximately $200,000 in his closing argument. The jury awarded a total of $30,000 in damages which was reduced as per the stipulations to a judgment of $14,800.
The last offer had been $10,000 prior to trial. The last demand was $80,000. The Plaintiff accepted the $14,800 verdict and dismissed a separate bad faith claim he had asserted based upon what he claimed to have been an inadequate evaluation of his damages.
