Lawsuit for uninsured motorist coverage benefits arising out of freeway accident caused by a phantom motorist. The driver of the insured vehicle traveling a posted speed of 65 m.p.h. lost control as a result, flipping the vehicle over four times. Two plaintiffs asserted claims for bodily injury as a result. A male teenager claimed to have lost college football scholarships due to a shoulder injury sustained in the accident. A female teenager claimed migraine headaches and aggravated asthmatic condition from a closed head injury with resulting post concussive stress disorder. Four day jury trial in Federal District Court. Liability for accident stipulated. Case tried on damages only. Defense verdict rendered in favor of insurer as to both claims.
