APPELLATE PRACTICE

Ohio has eighty-eight counties, each of which has a Court of Common Pleas in which lawsuits are generally originally heard. The Ohio appellate system is comprised of twelve district courts of appeals and the Ohio Supreme Court. In addition to the Ohio Rules of Appellate Procedure that govern all Ohio appellate courts, each appellate district has its own local rules and procedures, with which a party must comply to appeal from the applicable Court of Common Pleas. There are federal courts in Ohio, which are divided into two districts with one federal circuit court of appeals. The federal rules of appellate procedure are separate and distinct from the Ohio rules, and they are again strictly enforced. Accordingly, selecting an attorney that is familiar with the rules of appellate procedure is vitally important. Further, effective appellate advocacy hinges upon thorough research of legal precedent, the preparation of clear and concise appellate briefs, and effective oral argument before a panel of appellate judges.
